1. Your Agreement with Justype

These Terms of Service ("Terms") govern your use of the JusType platform and services (collectively, the "Service"). By using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you are agreeing to these Terms for that organization and promising that you have the authority to bind that organization to these terms.

2. Use of the Service

• Your Responsibility: You are responsible for your use of the Service and for any content you provide, including compliance with applicable laws, rules, and regulations.

• Acceptable Use: Your use of the Service must comply with our Acceptable Use Policy, which is incorporated by reference into these Terms. A violation of the Acceptable Use Policy will be considered a violation of these Terms.

• User Accounts: You are responsible for safeguarding your account and for all activities that occur under it. JUstype cannot and will not be liable for any loss or damage arising from your failure to comply with the above.

3. Content and Data

• Ownership: You retain ownership of the input you provide to the Service and the output generated for you ("Content").

• Our Limited License to Your Content: You grant JusType a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your Content solely for the purpose of providing and improving the Service.

• No Training on Your Data: We will not use your Content to train our AI models. Our subprocessors are also prohibited from using your Content to train their models.

• Confidentiality: We will treat your Content as confidential information. We will use the same degree of care that we use to protect our own confidential information, but in no event less than reasonable care.

4. AI and Service Limitations

• AI-Generated Content: The Service uses artificial intelligence and machine learning, which are rapidly evolving fields. The output generated by the Service may be incorrect, incomplete, or otherwise not reflect real facts.

• No Professional Advice: The output of the Service does not constitute professional advice. You are solely responsible for evaluating the accuracy and appropriateness of the output for your use case, including through human review.

5. Intellectual Property

• Our IP: All rights, title, and interest in and to the Service (excluding Content provided by users) are and will remain the exclusive property of JusType and its licensors.

• Feedback: We welcome your feedback, but please note that we may use any feedback, comments, or suggestions you send us without any obligation to you.

6. Termination

You're free to stop using our Services at any time. We also reserve the right to suspend or end the Services at any time at our discretion and without notice. Upon termination, we will take reasonable steps to allow you to export your Content.

7. Disclaimers and Limitations of Liability

• Warranty Disclaimer: The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted or error-free.

• Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL JusType BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOOD-WILL, OR OTHER INTANGIBLE LOSSES. IN NO EVENT SHALL JUSTYPE'S AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (U.S. $100.00) OR THE AMOUNT YOU PAID JUSTYPE, IF ANY, IN THE PAST SIX MONTHS FOR THE SERVICES GIVING RISE TO THE CLAIM.

8. Indemnification

You agree to defend, indemnify, and hold harmless JUstype, its affiliates, and its and their respective officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; or (iii) your Content.

9. General Terms

• Governing Law: These Terms and any action related thereto will be governed by the laws of the State of [Your State] without regard to or application of its conflict of law provisions or your state or country of residence.

• Dispute Resolution: All claims arising out of or relating to these terms or the services will be litigated exclusively in the federal or state courts of [Your County, Your State], USA, and you and JusType consent to personal jurisdiction in those courts.

• Changes to Terms: We may revise these Terms from time to time. If we make a change to these Terms that, in our sole discretion, is material, we will provide you with advance notice. By continuing to access or use the Services after those changes become effective, you agree to be bound by the revised Terms.

• Entire Agreement: These Terms constitute the entire and exclusive agreement between JusType and you regarding the Services.
